Mortgage Fraud in the State of Florida
The following is a transcript of an interview done on our theft, fraud, and forgery cases with a focus on mortgage fraud.
Ladan Law: We talked about a good number of the things. There have been some cases that I’ve handled where there was some price-fixing on an entire neighborhood’s worth of property. Mortgage fraud is becoming a big issue down here and is being very aggressively prosecuted, both from a home lender and a homeowner perspective. The Attorney General has really started to take a look at the natural predatory behavior of thieves with the housing bubble collapse and the current crisis that we have as far as property values down here and all the things that stem from that.
It’s often times a statewide case. They’re very serious about the prosecution and, if you find yourself in a white-collar offense or accusation, based on anything that has to do with the house and market here in Florida, you absolutely need an experienced attorney.
You need an attorney experienced in those types of cases to give you some guidance because these cases are very long, and the state has broad authority to seize your property and tie it up for years. There may be some actions you need to do to safeguard what little assets you have so you have the ability to post bond or hire a reasonable attorney. Those are often times procedures that can be done before a physical arrest happens.
